By accessing and using MindWave ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

MindWave provides a high-fidelity interactive learning platform designed for educational institutions. The Service includes:

  • Interactive, live session creation tools (Quizzes, Polls, Feedback overlays).
  • Student progress tracking, cognitive analytics, and graphical performance charts.
  • Multi-tenant department and organization management controls.
  • Course material repositories, syllabus uploads, and class portals.
  • Advanced learning modules like in-browser Code Practice, SQL Challenges, and AI tutoring.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and update your credentials to keep them secure and accurate.
  • Accept responsibility for all activities occurring under your authenticated credentials.
  • Notify us immediately of any unauthorized system access or security breaches.

3.2 Account Types

MindWave offers different role profiles based on academic hierarchies:

  • Students: Participate in live sessions, access the AI Tutor, complete assignments, and track achievements.
  • Faculty: Host live sessions, design custom interactive tasks, review class grades, and audit telemetry.
  • Admin / HOD: Oversee department courses, delegate credentials, review aggregate reports, and manage access limits.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any local, national, or international academic policies or legal regulations.
  • Attempt to bypass live session security measures (including anti-cheat and focus tracking controls).
  • Transmit harmful, offensive, plagiarized, or inappropriate content.
  • Disrupt or interfere with the performance of our self-hosted database cluster or servers.
  • Attempt to harvest user data or reverse-engineer the proprietary logic of the platform.

5. Intellectual Property Rights

5.1 Our Rights

The Service, branding, UI designs, code engine, and original content are owned by MindWave and are protected by copyright, trademark, and intellectual property laws.

5.2 Your Rights

You retain all rights to the educational content, session items, and class files you create using the Service. By using the platform, you grant us a standard license to store and process your content solely for the purpose of executing the Service.

6. Payment and Billing

6.1 Subscription Fees

Certain high-capacity institutional tiers require payment of subscription fees. You agree to pay all fees associated with your chosen licensing tier.

6.2 Billing Cycle

Subscription fees are billed in advance on a recurring monthly or annual basis, synchronized with your academic planning cycle.

6.3 Secure Processing

We process payments securely via industry-compliant third-party gateways (Stripe/Razorpay). We do not store credit card credentials on our servers.

6.4 Refund Policy

We provide a 14-day refund window for initial subscription activations. Renewals and adjustments are not subject to refund once billed.

7. Cancellation and Termination

You may cancel your licensing subscription at any time via the billing portal. MindWave reserves the right to suspend or terminate accounts in instances of severe Acceptable Use Policy violations, fraud, or unpaid outstanding balances.

8. Data Privacy and Security

Your privacy is important to us. All personal data collection, storage, and processing policies are governed by our Privacy Policy. We implement rigorous standard encryption procedures to secure user records and session logs.

9. Limitation of Liability

To the maximum extent permitted by law, MindWave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of grading data, system down-time, or instructional delays.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF PEDAGOGICAL OUTCOMES, FITNESS FOR A PARTICULAR PURPOSE, OR SYSTEM COMPATIBILITY.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising under these terms shall be resolved exclusively within the courts of Bangalore, Karnataka.
